The last thing that  Khalid Sheikh Mohammed should be allowed is martyrdom, unfortunately he probably has that already regardless of the outcome of his trial at Guantanamo Bay. You can’t run around the world talking about freedom, democracy and justice unless you embody those principles in the way you treat others, even if they are terrorists. Writing off those ideals at the stroke of a pen on a presidential proclamation of some sort shows exactly how worthless they are, they shouldn’t be allowed to be suspended under any circumstances, otherwise you’re no better than the other side.

The only thing that can be done now is to hold a full trial under American law, make sure that it is open to the world, that means he gets exactly the same rights as a US citizen, otherwise the trial is a sham. America should also remove the death penalty for this trial, let him live out his days in one of the supermax prisons, give him his Koran, point him to the east and let his people forget him and what he stood for. It will be a harsher punishment than any other.
