Abu Hamza Extradition

Via the Telegraph the news that Abu Hamza is being held on an extradition warrant from the US.
Something that may surprise Americans about this. The US must sign a written declaration that he will not be subjected to the death penalty before he will be handed over. Over here it has been enshrined in law that capital punishment is cruel and unusual punishment: a country cannot be a member of the European Union if it has it, for example (although there are exceptions for time of war and military justice). So, if a prosecutor intends to try someone on a capital charge, even Osama Bin Laden, an EU country simply will not hand them over.
This doesn’t make a great deal of difference to the US courts, as they have repeatedly ruled that how someone ended up in them, or whatever was promised before they do, has no effect on the US justice system.
Just to show you quite how rigid the system is, if Terry Nichols had been arrested in Europe and then extradited, then he would be serving life.
